- HB2434 clarifies and expands an existing option for eligible Employees Retirement System of Texas (ERS) members to buy retirement service credit for work performed during a 90-day membership waiting period.
- An eligible member may establish credit for each month of any qualifying 90-day waiting period in which the member performed service, regardless of whether the member made a contribution during that waiting period.
- This is a purchase, not free credit: The existing law bases the deposit on the actuarial present value of the additional standard retirement benefits—the amount calculated today to cover those future benefits—using the system’s adopted rates and tables.
What does it do?
HB2434 clarifies and expands an existing option for eligible Employees Retirement System of Texas (ERS) members to buy retirement service credit for work performed during a 90-day membership waiting period. The surrounding statute limits this option to a member who became a member before September 1, 2015. The act does not open it to every current state employee. Final law, Section 1; full eligibility and purchase provision.
An eligible member may establish credit for each month of any qualifying 90-day waiting period in which the member performed service, regardless of whether the member made a contribution during that waiting period. If a purchased month predates the member’s most recent hiring date, ERS must treat the first day of the earliest purchased month as the hiring date for purposes of the ERS statutory subtitle. That can matter where retirement rules use a hiring date; it does not rewrite employment seniority for every purpose or guarantee a particular person a particular retirement benefit. Final law, Section 1.
This is a purchase, not free credit. The existing law bases the deposit on the actuarial present value of the additional standard retirement benefits—the amount calculated today to cover those future benefits—using the system’s adopted rates and tables. HB2434 adds an express requirement that ERS calculate the deposit so it does not produce an actuarial loss to the system. Approved credit is granted after the required deposit. The act took effect September 1, 2025. Full purchase provision; final law, Sections 1–2; official history.
What changed along the way?
The introduced, House committee and engrossed versions contain the same substantive changes. The Senate committee and enrolled versions differ only in printing and certification material. Both committees reported the bill without amendments, and the official amendment index lists none. The rule for earlier purchased months and the no-actuarial-loss requirement were in the proposal from the start, not additions made on the floor. Who could benefit—and who could bear the costs?
Eligible members with qualifying waiting-period service, including service before a later hiring date, gain an expanded opportunity to obtain credit. The member bears the purchase price; whether buying it is worthwhile depends on the person’s service history, benefit effect and ERS’s quote. The act supplies no flat price, discount or automatic pension increase for everyone. Final law; purchase statute.
The Legislative Budget Board’s May 20, 2025 engrossed fiscal note anticipates no significant state fiscal implication and no local-government fiscal implication. ERS reported that the purchase price would cover the cost of the benefits, avoiding an impact on its pension plans. The April 22 introduced note agrees. The April 22 actuarial impact statement additionally anticipates that administrative costs would be charged to purchasing members. Those are funding assumptions, not a statement that members pay nothing. Engrossed fiscal note; introduced fiscal note; actuarial impact statement.
