What does it do?
HB388 requires a uniform coordination-of-benefits questionnaire for the health plans it covers. This paperwork gathers information used when a patient has more than one source of health coverage. The insurance commissioner must work with appropriate stakeholders to establish the questionnaire by rule. A covered plan issuer whose plan includes a coordination-of-benefits provision must use it and make it available to health care providers as appropriate. Final law · Official committee explanation of the paperwork problem
The law lists the covered insurance arrangements rather than simply covering every possible health plan. Its list includes specified commercial insurance and HMO coverage, small-employer and certain standard plans, listed public-employee and education-related plans, Medicaid and Medicaid managed care, CHIP, specified regional or local health programs, Texas Mutual subsidiary alternative coverage, and self-funded plans sponsored by professional employer organizations. The express reference to those last plans should not be read as a blanket statement about all self-funded employer plans. Scope: section 1203.151
HB388 took effect September 1, 2025. It set January 1, 2026 as the rule-adoption deadline and applies to questionnaire use on or after February 1, 2026. These are the law’s dates, not a finding here that every issuer complied or that a particular patient’s claim was processed correctly. The bill standardizes a form; it does not itself determine which insurer pays a particular claim, require duplicate payment, or expand covered medical services. Requirements and transition dates

Who could benefit—and who could bear the costs?
Patients with multiple sources of coverage, providers and plan administrators could benefit from more consistent paperwork. The committee analysis describes reducing form-related errors and billing problems as the bill’s purpose; it does not establish that those results have occurred. Issuers and administrators must adapt their forms and workflows to the common questionnaire. Committee analysis · Required issuer use
The Legislative Budget Board anticipated no significant state or local-government fiscal impact and assumed implementation costs could be absorbed using existing resources. It supplied no quantified patient savings or private-insurer compliance estimate. HB388 makes no appropriation and does not promise that all billing disputes will disappear. Latest posted fiscal note
