What does it do?

HB5437 retroactively validates and confirms the creation of Austin County Municipal Utility District No. 1 and acts and proceedings related to its creation, effective as of when they occurred. It expressly includes temporary directors’ acts taken within the five years before the act took effect, including calling elections to confirm the district, elect permanent directors and approve bonds and property taxes. Final law, Section 1(a).

The act specifically validates orders declaring the results of the November 2, 2021 election, including district confirmation, election of five permanent directors, approval of water, sewage, drainage and road bonds and property taxes, and each proposition passed at that election. It is a validation of specified earlier authority and actions—not a newly stated bond amount, a new tax rate or evidence that bonds were actually issued. The underlying district law already provided for a confirmation/director election and temporary directors. Final law; district law, Sections 7913A.0103 and 7913A.0202.

Two exceptions remain: the validation does not apply to an act, proceeding, director, other official, bond or obligation whose validity was being litigated when the act took effect, or to an act or proceeding already held invalid by a final court judgment. This briefing does not assert that no such lawsuit or judgment exists. Section 2 records the legislature’s findings that required notice, environmental-agency recommendations and passage procedures were satisfied. Final law, Sections 1(b)–2.

The bill became law without the governor’s signature on June 20, 2025, and took effect immediately. The final certificates show House passage 104–44 and Senate passage 27–4, meeting the two-thirds immediate-effect condition. Official history; final law, Section 3 and certificates.

What changed along the way?

The introduced, House-report, House-passed, Senate-report and final versions preserve the same validation language, litigation/final-judgment exclusions and effective-date provision. The amendment index lists no floor amendments, consistent with the passage history. No later amendment added the November 2021 election or removed the litigation protections. Who could benefit—and who could bear the costs?

The district, landowners, developers and parties relying on its election and financing authority may benefit from greater legal certainty for the covered actions. District taxpayers remain affected by the validated tax/bond propositions; this act supplies no rate, repayment schedule or household tax estimate. Parties protected by the express litigation or final-judgment exceptions do not lose those exceptions merely because this validation law passed.

The latest indexed fiscal note, May 21 for the engrossed bill, anticipates no significant state or local fiscal implication, assuming any costs can be absorbed using existing resources. The April 16 introduced note reaches the same conclusion. Neither gives a dollar amount or multi-year table, and neither means district property taxes or bond repayment are zero. The act makes no appropriation. Applicable fiscal note; introduced note.

Review boundary: all final sections, history, all five text versions, the empty amendment index, both fiscal notes and the prior district provisions governing confirmation and temporary directors were read and compared. This is not a district financial audit, an independent canvass of the 2021 election or a docket search determining whether a particular action falls within the litigation exclusions.
