What does it do?

SB1532 removes a requirement for the Texas Water Development Board to automatically post nonconfidential material from approved State Water Implementation Fund for Texas applications on its website. It leaves the section’s other listed reporting requirements intact. Signed May 19, 2025, it took effect September 1, 2025. Final law; Official history.

What changed along the way?

Previously, Water Code §15.440(b)(7) required online posting of any nonconfidential information submitted as part of an approved application for financial assistance under this subchapter. The act deletes that item and renumbers the remaining items. It does not create a new confidentiality exemption, prohibit voluntary posting or decide whether a particular record must be released under another law. Prior reporting law; Final law.

The board must still post and regularly update:

  • Statewide and regional progress in developing needed water supply.
  • Descriptions of projects financed through bonds supported by the specified bond-enhancement agreements, including expected completion, current status, bond amounts and terms, agreement summaries, loan repayment status and standardized default-risk assessments.
  • The fund’s investment portfolio, investment expenses and rate of return.
  • The project-prioritization point system and points awarded to each project.
  • Administrative and operating expenses for the state water plan and financial assistance, plus other information required by board rule.

The separate report to state leaders and legislators, due December 1 of each even-numbered year, is not amended by this bill. Final law; Prior reporting law.

All five indexed versions—introduced, Senate committee, Senate-passed, House committee and final—have the same operative provisions. Neither committee substituted a different policy, and the amendment index lists no amendments. Introduced; Senate committee; Senate-passed; House committee; Version index; Amendment index.

Who could benefit—and who could bear the costs?

The board has a narrower automatic posting duty. Members of the public may have less application-level material guaranteed to be available directly on the website, although the specified project and fund reports remain required. That is a change in the legal posting obligation, not evidence that the board actually removed documents or denied a records request. The act does not change funding eligibility, award a project money or alter the project-ranking criteria. Final law; Prior reporting law.

The March 16 fiscal note anticipates no significant state or local-government fiscal impact and says state costs can be absorbed using existing resources. It does not quantify staff savings or the public’s information-search costs. There is no appropriation in this act. Fiscal note; Final law.
