What does it do?
SB510 broadens when the Secretary of State may withhold specified election funds from a voter registrar who fails to perform required duties on time. It reaches duties under the Election Code involving approval, changes or cancellation of registration; scheduling specified registration-challenge hearings; deciding those challenges; and delivering residence-confirmation notices under Section 16.0921. It is not limited to removing voters from the rolls. Covered duties.
Before withholding funds, the secretary must give the registrar written notice of the alleged violation and a reasonable opportunity to correct it. Withholding is discretionary, not automatic. The retained rule requires distribution if the registrar performs the duty within 30 days after funds are withheld. That 30-day restoration rule is separate from the reasonable opportunity required before withholding. Notice, correction and restoration.
The funds are those administered and distributed under Chapter 19 or Section 31.009—not all county revenue or the registrar’s personal salary. The secretary must adopt administrative rules. Signed June 20, 2025, the act took effect September 1, 2025. Funding scope and rulemaking; History.
What changed along the way?
The bill moves former Section 16.039 to Section 12.007 and expands the earlier authority beyond duties in the registration-cancellation subchapter. The introduced, Senate committee, engrossed and House committee texts already contained the broader list and retained the 30-day restoration provision. Introduced text and prior wording; All five versions.
Bucy’s sole indexed House amendment added written notice, a reasonable opportunity to correct the alleged violation before withholding, and mandatory rulemaking. It was adopted May 27 and retained in the final act after Senate concurrence May 30. A description of the earlier version without those safeguards would be incomplete. Who could benefit—and who could bear the costs?
The state gains a broader financial compliance tool, while registrars gain an express notice-and-correction safeguard. A registrar’s office could lose access to the specified funds while noncompliance remains unresolved. The act does not itself cancel a particular voter’s registration, change voter eligibility or impose a criminal penalty on the registrar. Administrative enforcement and limits.
The March 26 introduced and May 28 House-passed fiscal notes, including the duplicate final posting, anticipate no significant state or local fiscal impact and assume costs can be absorbed with existing resources. They do not estimate how often funds will be withheld or the amount a particular registrar might lose temporarily. Final fiscal posting.
