What does it do?

SB767 requires the Texas Forest Service to create and maintain a statewide database of firefighting equipment available for wildfire response. The database must show the inventory in real time, be searchable by location and equipment type, and include each department’s available equipment types and contact information. All Texas fire departments must be able to access it and update their own equipment information. Signed May 19, 2025, it took effect September 1, 2025. Final law; History.

“Fire department” includes volunteer departments and departments of municipalities, counties, special districts or authorities that provide firefighting services. The Forest Service must assist a department that supplies information with updates annually or as soon as practicable after an availability change, and send an electronic reminder at least once each calendar year. The law requires department access; it does not itself require an unrestricted public equipment map. New Education Code 88.1255.

This is an information and coordination requirement, not an appropriation to purchase trucks or an order transferring ownership or control of local equipment. “Real time” describes what the law requires of the database; the act alone does not prove that every department has supplied current data or that equipment will be available at a particular emergency. Database requirements and limits.

What changed along the way?

The introduced and Senate committee texts matched. Sparks’s adopted Senate amendment made assistance with updates mandatory rather than optional and added annual electronic reminders. Fairly’s adopted House amendment replaced the operative bill, moving it from Government Code Chapter 418 to Education Code Chapter 88, specifying the covered departments and retaining the database, assistance and reminder requirements. The Senate concurred on May 5. Introduced; Sparks amendment; Fairly amendment; Both adopted amendments; Concurrence history.

Who could benefit—and who could bear the costs?

A searchable inventory can help responders find nearby equipment and the department to contact. Its usefulness depends on accurate updates and actual availability; the legislation does not quantify faster response times, acres protected or lives saved. Required information and updating.

All four fiscal-note versions were reviewed. The May 1 final available note anticipates no significant state fiscal impact, assumes costs can be absorbed with existing resources, and anticipates no local-government fiscal impact. It does not assign a dollar amount to the database or claim a new equipment-purchase allocation. Final fiscal note; All versions and fiscal notes.
