HB171 correction: eligibility for the misdemeanor treatment alternative
Correction · November 5, 2026 (Texas)
The original explanation omitted an eligibility restriction for the misdemeanor sentencing alternative: under Health and Safety Code section 462.081(b), a defendant whom the court considers to be a person with mental illness is not eligible for sentencing under that section. This is an existing restriction that HB171 did not change.
Source: Health and Safety Code section 462.081(b). Final 89R HB171, section 7 changes subsections (a) and (d), not this existing subsection (b).
This correction checks only that existing misdemeanor-sentencing restriction. It does not change the explanation of the 30-day treatment rule or its discharge exception, and does not assert a general exclusion from chemical-dependency treatment or resolve juvenile-court eligibility.
The existing explanation is preserved with a dated addendum. This correction adds neither a completed full review nor a new bill explanation.
